OWNERSHIP AND LIABILITY REGIME OF THE SOCIAL SECURITY E-OFFICE

Pursuant to sections c) and d) of Article 10.2 of Royal Decree 203/2021 of 30 March approving the Regulation on the action and operation of the public sector by electronic means, the act or resolution creating an e-Office shall determine the identification of its owner as well as the body or bodies responsible for its management and the services made available therein.

The e-Office of the State Secretariat for Social Security was created at the time through  Order TIN/1459/2010 of 28 May creating the e-Office of the State Secretariat for Social Security (https://sede.seg-social.gob.es/). With regard to the liability regime of the e-Office, the aforementioned Order states that:

  1. The e-Office will be owned by the State Secretariat for Social Security (now the State Secretariat for Social Security and Pensions).
  2. The technological management of the e-Office shall be the responsibility of the Social Security IT Management.
  3. Those responsible for the management, contents and services made available to citizens via the e-Office shall be the heads of the general directorates, Common Services and Management Entities attached to the State Secretariat for Social Security and, where appropriate, of the bodies that are incorporated into the e-Office. Responsibility shall correspond to the competences attributed to each of the holders by the legislation in force.
  4. The management of the common contents of the e-Office and coordination with the general directorates, common services and managing bodies dependent on the State Secretariat for Social Security shall be the responsibility of the latter, which shall be exercised through its Cabinet.

In accordance with Article 12 of Royal Decree 203/2021 of 30 March approving the Regulation on the action and operation of the public sector by electronic means:

  1. The owner of the e-Office and, where appropriate, of the associated e-Office, shall be responsible for the integrity, veracity and updating of the information and services within its competence that may be accessed through it.
  2. In the event that the e-Office or associated e-Office contains a link to another site or associated site, the owner of the latter shall be responsible for the completeness, veracity and updating of the information or procedures contained therein, without prejudice to the due diligence of the owner of the former with regard to the incorporation of the contents therein.

The e-Office has the necessary means for citizens to know whether the information or service they are accessing corresponds to the e-Office itself or to an access point that is not an e-Office or to a third party. In this sense, the links in the e-Office indicate whether accessing them means leaving the e-Office itself.
